1. Course Purchases and Enrolment
1.1 By accepting these terms and conditions ("T&Cs") the participant agrees to pay the course fees inclusive of GST by using the payment method nominated at checkout.
1.2 The participant accepts that he/she is required to pay the full amount of the course fees at the time of purchase.
1.3 Payments will only be accepted from customers aged 18 and over.
1.4 All prices displayed on learn.westernkidshealth.com ("the website") are in Australian Dollars inclusive of GST.
1.5 Purchase is complete when the participant has been issued login access for the online course.
1.6 The course access period commences from the date access to materials is granted.
1.7 Special offer or discount coupon codes cannot be added to a purchase retrospectively. They must be added at the initial time of purchase.
1.8 Course purchases are non-transferable.
2. Intellectual Property
2.1 The content of our website and any intellectual property rights attached herein belong to Western Kids Health Pty Ltd, or to someone who has given Western Kids Health permission to use it.
2.2 The Western Kids Health name and logo cannot be used without our prior written consent.
2.3 All content on this website, including but not limited to text, graphics, logos, photographs, audio, video and data compilations, is the exclusive property of Western Kids Health Pty Ltd or its content suppliers, protected by Australian and international copyright laws.
2.4 To avoid doubt, you must seek the written permission of the Managing Director of Western Kids Health prior to publication of any aspect of our website.
3. Course Materials and Access
3.1 Course materials are supplied in an online environment unless otherwise stated in the course description, and are available for viewing online.
3.2 Course materials comprise written materials, web presentations, videos and other learning resources.
3.3 Course materials may not be downloaded unless specifically provided for download.
3.4 Access to each course is provided for the access period stated in the course description at the time of purchase (for example, 3 months from purchase). After the access period ends, access to the course materials will cease. Downloadable resources saved during the access period remain yours to keep for personal use.
3.5 The content of the online course materials, including copyright and all other intellectual property rights contained therein, remains the property of Western Kids Health.
3.6 You may not reproduce any part of the online course materials without the prior written consent of Western Kids Health.
3.7 Course materials and content are subject to change.
3.8 Western Kids Health is not responsible for any delays or interruptions to the website or access to course materials. While we will use commercially reasonable efforts to minimise delays or interruptions, we cannot warrant that the website and course materials will be available at all times or at any given time.
3.9 Western Kids Health may at any time and without notice to you undertake maintenance on the website or discontinue the website in whole or in part.
4. Withdrawals and Refunds
4.1 Western Kids Health complies with Australian Consumer Law in regard to refunds. We are not required to provide a refund for change of mind after purchase.
4.2 Whilst course fees are non-refundable, participants may have extenuating circumstances that prevent them from undertaking their course. Where evidence can be provided to support the participant's circumstances, course access may be extended or fees may be refunded or partially refunded as per the following:
4.3 A full refund is permitted if the purchase is cancelled immediately and access to resources has not yet been provided.
4.4 A 50% refund is permitted if the purchase is cancelled within 7 days of the access commencement date.
4.5 No refund will be provided after 7 days from the access commencement date.
4.6 The decision in assessing extenuating circumstances rests with the Managing Director of Western Kids Health and shall be assessed on a case by case basis.
5. Credit Voucher / Coupon Code Policy
5.1 All credit vouchers and discount coupons have the following conditions of use:
- Not redeemable for cash
- Valid for one (1) use only
- Not valid with any other offer, gift voucher or coupon code
- The coupon code must be entered at the time of initial purchase; a discount cannot be applied at a later date
- The coupon code can only be used in the time frame specified in the special offer
6. Confidentiality and Privacy
6.1 Western Kids Health will make all reasonable efforts to keep your personal information secure.
6.2 Information provided by you is considered confidential and will not be divulged to any third party, sold, or used by our employees for any unauthorised use, modification, reproduction or disclosure.
6.3 We will only disclose information that we have about you: to the extent specifically required by law, or for the purposes of this agreement (including disclosing information in connection with any query or claim).
6.4 Upon purchase of a course, we may use the content from your emails in our marketing material and on our website testimonials page, and may send you our newsletter. You can unsubscribe from marketing emails at any time.
6.5 Where testimonials are used, your identity will not be fully revealed; we will use your surname initials and city only. Only comments related to course outcomes and participant experiences will be used.
7. Medical Disclaimer
7.1 The information provided on our website is for general education purposes only and does not constitute medical advice. Nothing in the website, courses, guides, videos or newsletters, or anything associated with them, should be taken or understood as medical advice or assistance, nor should it be interpreted as a substitution for any medical advice or assistance, or used or referred to instead of seeking appropriate medical advice or assistance from qualified practitioners for your particular circumstances and needs.
7.2 You understand and accept it is your responsibility to evaluate and assess yours, or your child's, own health and wellbeing and whether, in all the circumstances, you should access and use the website and/or participate in the courses, guides, videos or newsletters.
7.3 Our courses and guides are designed to empower parents and caregivers through information about child development. We do our best to keep the information published on our website up to date and accurate. However, some information may from time to time be incorrect, out of date or inaccurate partially or in its entirety.
8. Limitation of Liability
8.1 To the maximum extent permitted by law, we do not provide warranties on any product or services offered by Western Kids Health.
8.2 To the extent permitted by law, Western Kids Health, including our directors, officers, employees, agents, contractors, successors or assigns, will not be liable for any injury or damage of any kind arising out of or in connection with: the items displayed on our website; the use of our website or any website with which it is linked; the services displayed, offered or provided through a course on the website, or services offered or displayed on external websites with which our website is linked; or the information published on our website.
8.3 Nothing in these T&Cs restricts, modifies or excludes any condition or implied warranty, or any liability imposed upon us by the Australian Consumer Law.
9. Applicable Jurisdiction
9.1 These T&Cs shall be construed in accordance with and governed by the laws of Western Australia. You consent to the exclusive jurisdiction of the courts of Western Australia to determine any matter or dispute which arises between us.
9.2 If any part of these T&Cs becomes unenforceable, that part is, or will be, severed from the T&Cs so that all the remaining parts remain in full force and effect and are unaffected by that severance.
